Anne Njeri Njoroge: Woman in middle of Sh. 17 billion diesel controversy

Anne Njeri Njoroge. This is the woman who has been linked with Sh. 17 billion diesel that was stuck in a ship at the port of Mombasa.

Anne Njeri Njoroge who has been missing for days has been found. This has been confirmed by her lawyer Cliff Ombeta, who said that she was abandoned at Nyayo Estate area in Embakasi, Nairobi.

She was found one day after one of her lawyers David Chumo sued the Directorate of Criminal Investigations (DCI) over her disappearance.

Chumo had alleged at the High Court that Ms Njoroge disappeared on November 9 when she visited the DCI to record a statement over the multi-billion contested diesel.

Ms Njoroge through her company, Ann’s Import and Export Enterprise LTD, had sued Galana Energies Ltd, Kenya Ports Authority, and the Kenya Pipeline Company Limited over the diesel.

She had obtained High Court orders from Justice Magare Kizito barring the Kenya Ports Authority (KPA) and Kenya Pipeline from offloading the fuel. This fuel was however offloaded despite the court order.

Galana Energies who were contracted by Amarco laid claim to the 100,000 metric tons of diesel that they claimed to have sourced from Saudi Arabia.

According to court documents, Galana Energies had said that Ann’s Import and Export Enterprises was not authorised to deal in importation and supply of petroleum products in the country.

However, Ms Njoroge in a statement to the police, said that she had imported 100,000 metric tonnes of diesel loaded on vessel Haigui.

She said that the Haigui took around 15 days from Russia to Mombasa through, Abzerbaijan Republic, Turkey, Jedda and the Port of Ceyhan.

She said that her company Ann’s Import and Export LTD was an international company with offices in both Kenya and Dubai.

She said that her company where she is the sole director has an account with LLC ALPHA-AAA YTBE) (AEHO MOSCO-RUSSIA for facilitation, loading and transportation of petroleum products.

However, the Kenya Ports Authority (KPA) issued a statement disowning Ms Njoroge as the real owner of the fuel.

In its response to Ms Njoroge, Galana has disputed her ownership and claimed that the multi-billion diesel arrived at the port of Mombasa on October 11, 2023. On the same day, a notice of readiness was issued to KPA showing intention to immediately offload.

Galana further claimed that the vessel was berthed on November 4. This is in contrast to documents that were produced by Ms Njoroge that show Ullage Report after loading is dated October 2, 2023.

Galana further claimed that Ms Njoroge’s Bill of Lading and cargo manifest are dated October 9 2023, which is in contrast with the Ullage Report after Loading.

On its part, the KPA has accused Ms Njoroge of forging documents she used to claim ownership of the consignment. KPA Managing Director Captain William Ruto and Board Chairperson Benjamin Tayari, the management said Galana Energies Limited had the genuine importation documents.

KPA claimed that records in their possession show that the vessel with the contested oil was carrying 93,460 metric tonnes of gas oil as opposed to the 100,000 metric tonnes of diesel that is being claimed by Ms Njoroge.

KPA further claimed that the diesel was loaded between 26th and 28th September at Yanbu – Samref terminal, after which it departed for anchorage at Jeddah. The vessel carrying the diesel then departed for Mombasa on September 30th.

Out of the manifested 93,490 metric tonnes of Gasoil, KPA says, 49,091 metric tonnes was destined to Kenya with the shipper being Aramco Trading Fujairah as nominated by the Ministry of Energy and Petroleum. The remainder 44,368 metric tonnes was transit cargo for neighbouring countries including Uganda, South Sudan and DR Congo.

KPA has also questioned claims by Ms Njoroge that the vessel carrying the oil originated from Azerbeijan Republic and was loaded at Jeddah. It claimed that the documents in their possession show Yanbu in Saudi Arabia as the origin of the cargo.
