Aisha Jumwa in soup over Sh. 250 million house she acquired on loan last year

Former Cabinet Secretary Aisha Jumwa is in soup over a multi-million house she acquired. The former CS has been dragged to court by Bejav Furniture Limited over the Sh. 250 million house that she bought in 2023.

In the suit, Bejav is seeking to have the court compel Aisha to pay Sh. 60 million that was part of the sale agreement. According to the suit, Aisha Jumwa placed a bid to acquire the house that was valued at a quarter a billion shillings four months after she was sworn in as Cabinet Secretary on October 27, 2022.

This house was owned by Roselyn Wambui. The court has heard that Aisha negotiated the price down from Sh. 250 million to Sh. 215 million.

“I instructed my advocate Kinyanjui Kirimi and Company Advocates to draw a sale agreement and send it to the defendant advocate, the firm of Mohamoud, Gitau, & Jillo LLP Advocates, which was done on February 25, 2023,” Wambui told the court on July 26, 2024.

She stated that Aisha’s advocates acknowledged that they received the sale agreement. However, the informed her that Aisha was being financed to acquire the property. She said that after talking to her lenders, Aisha was informed that she could only qualify for Sh. 145 million from KCB Bank Kenya.

“He advocates suggested on March 1, 2023, that we had to have an agreement for the sake of the banks (KCB and the Gulf Bank) and an addendum for the extra amount agreed between the parties, which was not being finance,” Wambui told the court.

She said that out of the balance that would not be financed by the bank, Aisha paid Sh. 10 million and committed to pay the remainder of Sh. 60 million within a period of 12 months.

“The issue of the 12 months was agreed upon and was even captured in the shared first draft agreement. It was clear and completely uncontested that the price of the house was Sh. 215 million,” Wambui informed the court. She transferred the house to Aisha and the house was then listed as collateral for the KCB Bank Kenya loan.

Since then, she has written multiple demand letters to Aisha asking her to pay off the remaining balance, all of which have been ignored. She now wants Aisha to pay the amount in addition to an 18.5 per cent interest.

On her part, Aisha has asked the court to dismiss the case saying that the court does not have jurisdiction to hear and determine the matter.
