The caretaker who sued landlord for evicting him from a piece of land he had lived for 32 years was, on Tuesday, June 6, awarded Sh3 million by a court.
The Environment and Lands Court in Shanzu ordered the landlord to pay his former caretaker Sh3 million as compensation for his devotion.
While issuing the order, Justice Lucas Naikuni said the caretaker had served his former employer for a long period, and it was unfair to evict him empty-handedly.
“To avoid the first plaintiff and his family becoming destitute and homeless, and in accordance with the right to housing and settlement guaranteed by Article 43 of the Constitution, I urge the defendant to consider awarding the first plaintiff a sum of Ksh3 million,” the judge ruled.

The caretaker moved to court in 2019 after he was ordered to vacate the land. While filing the case, he sought possession of the land, arguing it was sentimental.
He told the court he had lived on the piece of land for 12 years without any interruptions, and the family’s interest was overtaken by time.
His demands were, however, dismissed by the court, and he was ordered to pay his former boss Sh252,715 as the cost of the suit, forcing him to withdraw the case.
It was determined that the caretaker should have paid the landlord the sum before filing another case against him, which he did and later won Sh3 million.
