How lawyer Donald Kipkorir has made Sh. 1.3 billion from Nairobi County Government

City lawyer Donald Kipkorir has shocked many Kenyans after claiming earnings of Sh. 1.3 billion from the Nairobi County Government.

The lawyer is now set to be paid the huge amount for defending the Nairobi County Government against the Ministry of Defence in a case that involved the parcel of land where Embakasi Barracks is located.

This is after the Employment and Labour Relations Court ruled that Kipkorir should be paid Sh. 1.338 billion for representing City Hall.

Kipkorir had represented City Hall in the case that lasted for about ten years before the city council was converted into the county government.

“The 3,000-acre land valued at Sh. 61.5 billion was forcibly taken over by the Kenya Defence Forces, triggering the suit in 2012. But the matter was withdrawn in June last year, without the involvement of Kipkorir,” a report that appeared in the Business Daily on Wednesday said.

Apparently, the county government had opposed the amount, claiming that Kipkorir’s law firm, KTK Advocates had an agreement with city hall to be paid Sh. 400 million plus VAT.

However, this was rejected as the County Government did not provide proof showing the amount has been agreed upon.

“It is moreover quite unfortunate that no proof has been tendered to this court to show that there existed a retainer agreement between the parties other than an unsigned letter allegedly from the applicant firm,” the court registrar ruled.

Filings in court showed that Donald Kipkorir asked for instructions fees of Sh. 1.23 billion and Sh. 410 million for ‘getting up fees’ or costs incurred for the preparation of the case.

Other issues considered were writing hundreds of letters and notices, to and from the Attorney-General and other law firms, drawing affidavits, filing the court documents and getting hearing notices.
