Family abandons kin’s body at debtor’s restaurant over Sh. 400,000 debt

Drama ensued in Nakuru County, Bondeni area when the family and relatives of a deceased man decided to drop his body and leave it at his debtor’s restaurant.

They argued that the restaurant owner had a debt to the 60 year old dead man, amounting to Sh. 400,000 when he was alive. He died two weeks before the amount was to be discharged into his savings.

The deceased, Richard Ogendi is said to have loaned the restaurant onwer his life savings, to establish his well-thriving restaurant business. He had saved for 8 years in a table banking group before loaning out all his savings.

Ogendi’s cousin, Benson Mobegi asserted that efforts made to reach the restaurant owner were fruitless, and always ended up with more excuses.

“The businessman gave him a motorbike, which we estimate costs Sh. 150,000, assuming it was brand new. However, since his death, the businessman has been avoiding us,” he claimed.

“That is why we decided to leave my uncle’s remains here. We don’t want the full amount paid, but for him to commit to settling the debt,” Mobegi clarified.

According to relatives and locals, the businessman is wealthy and owns several cars in addition to his flourishing restaurant. However, the man did not even bother to contribute a cent during the fund-raiser.

Benson Mobegi added that the accussed went into hiding as soon as he heard the family had delivered the body at his restaurant.

They will not leave the premises until the full Sh. 400,000 debt is settled, thereafter, they can proceed with burial arrangements.

“We have strugled enough, we have gone to the police several times and no action is taken. I want to say that the body will not be moved until the deceased gets justice,” one of the family members said.

The family requests the man to come back and strike a deal with the family.

“If he does not give us the money today, he can commit in writing that he will pay the money over a certain period or give his title deed to commit that he will pay the money,” they insisted.

Locals living in the area have testified against the restaurant ower, stating that he is a serial debtor with a reputation.

“Locals have made several complaints about him with me and the police. Some have even gone as far as hiring goons to attack him but he never learns,” said the area Nyumba Kumi Chairperson.

Police officers arriving at the scene advised the family to take the body back to the mortuary, or proceed with burial arrangements. Then they would settle the Sh. 400,000 debt case later.

They threatened to take the body if the matter is not acted upon by the family immediately.

“We have advised them to take their body back t the mortuary or take it home (Kisii) for burial then come and pursue the debt case (in Nakuru) later, and if they do not take it back, we will take the body,” said the police commander.
