Fly540 Suspended: The Competition Authority of Kenya has ordered Fly540 to stop selling flight tickets.
The authority has also ordered troubled airline to refund customers who booked flights since September 30 2022 who are yet to fly by November 30, 2022.
“Fly540 is hereby directed to, with immediate effect, cease and desist from advertising flight bookings through electronic, print and social media or receiving any flight bookings from the Public or travel agents until the ongoing investigations are completed,” stated CAK.
The Competition Authority says that the operations certificate belonging to Fly540 has already expired.
“The Authority is also aware that your Air Operator Certificate (AOC) expired on 30th September, 2022 and accordingly you are not authorized to offer services,” CAK stated in a cease and desist order sent to Fly540 on November 15.
“Equally we are aware that you have suspended operations at the JKIA terminal 1D/terminal 2 and your offices at Watermark Business Park‚ Karen remain inaccessible to the affected public.”

The authority further said that it was probing whether the airline has contravened the constitution by false and misleading representation, as well unconscionable conduct in its operations.
“The Competition Act No. 12 of 2010 mandates the Authority to enforce consumers’ rights. These include the right to accurate information necessary for them to gain full benefit from goods and services, and specifically prohibits misrepresentation and false advertising,” CAK stated.
