BY THE STANDARD / SDE: A friendship which started on Facebook between a campus girl and flamboyant city lawyer Donald Kipkorir has led to a law suit in which she’s seeking over Sh. 100 million, a huge chunk of it being expenses for soft creature comforts.
But Kipkorir says he is not sure about the paternity of the child because his name is not on the birth certificate. Further, he says in his replying affidavit, he discovered that “since giving birth, the plaintiff has been cohabiting with another man presently even as this matter is before court.”
According to Kipkorir, this man has assumed responsibility over the child.
The Don, as Kipkorir is known, met Eva Wangui Wachira on the popular social media platform in 2011 and after several dates asked her to be his girlfriend. She was then a student at the University of Nairobi.
One thing led to the other and the other led to pregnancy in 2013, upon which, according to her court papers, Kipkorir dumped her and cut off links.
Eva, in her sworn affidavit filed in 2018, says Kipkorir told her he was not ready to have a family, that she was still too young and should continue with her studies.
Eight years since being put in the family way, Eva, now a single mother of baby boy, went to court and sued Kipkorir for over Sh. 100 million. This includes Sh. 17.5 million in annual child support and a further Sh. 10 million for the baby’s health insurance.
In a case filed at the Children’s Court in Nairobi, Kipkorir is being sued for having “failed, refused and neglected” his parental responsibilities.
Eva is demanding that “the defendant should also provide club membership for the minor at Karen Club, Nairobi Club, and Muthaiga Club and cater for the membership subscriptions required by the respective clubs.”
Eva laments that “the minor herein continues to suffer due to the negligence of the defendant who is the minor’s biological father, despite him being a man of means” she says in her affidavit in which she also wants Kipkorir to cough Sh. 100,000 for designer clothing for the minor, just like the way he dresses.
But Kipkorir argues that “pursuant to her claim that ‘I am a person of means who has connections with people at high places’ is further proof that she intends to exploit my status in society for her own benefit and not that of the child in question.”
Their affair kicked off on social media as Eva recalls in her affidavit:
“Sometime in 2011, while a student at University of Nairobi, I met Kipkorir through social platform commonly known as Facebook. In or around 2013, he asked me for dinner which I agreed to go and we subsequently dated for some time.
“During that relationship, he would invite me to his residence where I would spend the weekend with him and sometimes we would go to hotels. He would take me to holidays within and out of the country which would cost more than Sh. 300,000.”
She further claims that she became pregnant and gave birth to a baby son. “After my conception, he told me to terminate the pregnancy as he was no ready to have a family. I refused to terminate and he cut me off completely and even blocked my number and I could not access him,” she says in her affidavit.
Eva recalls the good times when Kipkorir would splash not less than Sh. 250,000 a month to her through his employees.
She continues in her affidavit: “He never sent money directly to me using his mobile number as he had informed me that his number was not registered on M-pesa services and he would use his agent and employees to remit the money to me.”
Eva claims she’s currently jobless and breaks down the expenses she wants Kipkorir to foot. They include a monthly house rent of Sh. 300,000 or alternatively buying her a house in Runda valued at around Sh. 75 million, Sh. 200,000 for food and Sh. 250,000 in monthly shopping.
Eva wants Kipkorir to pay fees directly to the school and a further Sh. 280,000 as “school-related expenses.”
Since Kipkorir has a collection of high end vehicles, Eva demands that the lawyer provide their baby with a Prado worth Sh5 million and Toyota Premio worth Sh1.2 million which will be used to take his son to school or out of town trips.
Entertainment allowances for the baby are pegged at Sh. 250, 000 a month and a further Sh. 70,000 for house help and gardener.
Eva is also demanding Sh. 500,000 for his birthday celebrations, Sh. 1.2 million and Sh. 1.5 million annually for holidays within and outside the country, Sh. 25,000 for water, Sh. 10,000 for gas, Sh. 3,000 electricity, Sh. 5,000 for garbage and Sh. 25,000 for security.
Kipkorir, in his affidavit says he will not subject himself to a DNA test to prove paternity because…“it is unconstitutional and an intrusion of someone’s privacy…” unless ALL her previous and current partners are subjected to the same test.
