Tv presenter sues Embakasi church over noise pollution

KBC Tv presenter Irene Muchuma has sued a church over noise pollution. Muchuma has sued Thomas Nzioki of Jesus of Victory Worship Centre for noise pollution and operating a church that is not registered.

The church is situated in Tassia-Embakasi Nairobi County. Ms. Muchuma in her petition says that she has attempted to engage with the church which is within a residential estate where she owns rental properties in vain.

She says that the continued operation of the Embakasi church is dangerous and harmful to the children living within the estate.

“The noise disturbance caused by the defendants warrants an ab order of injunction to stop the illegal operation of the church,” says Ms. Muchuma in her petition.

“They are frustrating me because they believe they have money to throw their weight around,” she lamented. Ms. Muchuma is being represented in court by lawyer Suyianka Lempaa.

“The defendants have been operating an unregistered church since 2014, causing unnecessary noise in the neighbourhood to the plaintiff family and pushing tenants away,” she further said.

She told the court that the church plays loud music whether there are people or no people in the church which has caused her sleepless nights.

“As a result of the noise, myself and my three-month-old baby have encountered difficulty in getting sleep,” Ms. Muchuma said. “Our right to a peaceful environment has been violated and continues to be violated for which we hold the defendant liable.”

The case will be heard in court on September 22, 2022.
