Did Nairobi lawyer murder his son in cold blood?

Lawyer’s Murder Case: On Sunday March 17 2019, a Nairobi-based lawyer Assa Nyakundi was arrested over the death of his son. 

The lawyer, who incidentally is representing a Nyeri-based magistrate accused of killing her husband, claims that he had shot his son to death accidentally. But his version of events has now elicited more questions than answers. Did he murder his son in cold blood?

Various theories are being advanced, including unverified rumours of incest on social media platforms.

But more solidly, a report in the Daily Nation had queried why the Toyota Axio that the lawyer is said to have been using when he accidentally shot his son had two bullet holes wide apart.

Doubts have also been cast on how his revolver pistol could have gone off despite having three stages of safety features.

“Part of the investigation will focus on why the Toyota Axio Joseph is said to have died in had two bullet holes at the back seat. A ballistics expert at the Directorate of Criminal Investigations (DCI) says that the holes were far apart, which raises questions regarding how the gun discharged. Mr. Nyakundi has been a licensed firearm holder for over two decades and his Glock pistol, according to the Austrian manufacturer, is equipped with three independent safety features to prevent accidental firing,” says a report in the Daily Nation.

The Nation also reports although Nyakundi had told the police that he had accidentally shot his son while they were driving home from church on Sunday at around 1pm, neighbours and security guards at the Patkside estate had not heard any gunshots.

According to Nyakundi, the unfortunate incident had taken place near the Judiciary Training Institute.

“Police are also investigating how Mr Nyakundi drove all the way to a hospital in the Parklands neighbourhood with his son bleeding to death in the back seat, before driving back to Muthaiga Police Station to report the incident. A Facebook believed to have been posted by his second-born son indicated that Joseph had been murdered in cold blood. The post has since been pulled down. ‘Goodbye my one and only brother,” the post on Mr Onsomu Nyakundi’s Facebook page read, before an eerie summary: “Brutal, cold-blooded murder.’ ” the Nation reports.
