You own Sh. 17bn fuel? Stop watching ‘Money Heist’ – Judge tells Anne Njeri

The High Court has dismissed claims by businesswoman Anne Njeri that she shipped in fuel worth Sh. 17 billion. And in a sarcastic caution, the High Court has advised the businesswoman to stop watching ‘Money Heist’ movies and get a grip on reality.

In a ruling that was delivered by High Court judge Justice Kizito Magare, the court found no evidence showing that the contested oil belonged to Njeri.

Justice Magare determined that all the documents that Ms Njeri submitted to the court did not prove that any purchase, import or requisition of the Diesel EN 590.

“The best I can describe the claimant’s claim is that it was an amateurish attempt at a heist. The claimant should stop watching too many movies, especially the money heist,” Justice Magare stated.

He further  ruled that all the evidence presented in court showed that the cargo offloaded was Gas Oil 50ppm Automotive Gas Oil (AGO). This was contrary to the Diesel EN 590 that Njeri was laying claim to. The court further found that the manifest with Kenya Revenue Authority (KRA) was for AGO.

“The diesel never arrived in the country. The goods that Galana Energies Ltd purchased are different from the purported ones by Ann’s Import and Export Enterprises Ltd,” Justice Magare ruled.

He noted  that in any case, Njeri ought to file her case in Jeddah where she may have been misled or otherwise initiated the scheme to steal the oil.

“Diesel EN590 never arrived and was not aboard the motor tanker Haigui. This is a proper case to strike out. It cannot be saved by amendment or otherwise,” Justice Magare added.
