Nairobi County to pay flamboyant lawyer Donald Kipkorir Sh1.3 billion

The Nairobi County government has been ordered to pay flamboyant city lawyer Donald Kipkorir Sh1.3 billion. The amount will be paid for legal services that Mr. Kipkorir provided in two cases in which he represented the county government. This order has been issued by the High Court.

The cases from which Mr. Kipkorir earned his heavy pay involved the ownership of a parcel of land that contested in court by the Nairobi County and the military. This case was over a 3,000 acre parcel of land located in Embakasi where the Embakasi Barracks are currently located. This land was claimed to have a value of around Sh61.5 billion.

Mr. Kipkorir had represented the defunct City Council when the case started in 2012. The case was later withdrawn in 2021 as the two contesting parties sought to resolve the matter through intergovernmental relations. The second case involved the legitimacy of Nairobi’s fire brigade by-laws.

In the court ruling, the High Court, through Justice John Chigiti ordered the county government to pay Mr. Kipkorir’s law firm KTK Advocates the amount within 60 days. The amount will be paid together with all the accrued interests. This order was issued on April 3, 2025.

“The [Nairobi County] has refused, failed and neglected to settle the amounts in entirety. This court is satisfied that KTK Advocates had a legitimate expectation that the respondents would settle the claim as set out in the Certificates of Order against the government which the respondents have failed to do without any explanation or justification,” the High Court ruled.

In early 2024, Mr. Kipkorir had enlisted the services of Garam Auctioneers and issued an instruction letter to the auctioneer on March 27, 2024. He had instructed the auctioneer to seize the City Hall properties including valuables, office equipment, computers, furniture and cars to recover the debt.

According to court filings and proceedings which were not opposed by the county, there are two fee notes that the county owes Mr. Kipkorir and his law firm. The two fee notes total Sh1,338,709,459. The first of the two notes totals Sh1,338,011,582 while the second totals Sh697,876.
