Police officer with Sh. 20,000 salary, Sh. 30 million wealth loses everything

A police officer who earns Sh. 20,000 per month has accumulated wealth amounting to over Sh. 30 million.

The police officer, Chief Inspector Gabriel Mbiti Mulei, has Sh. 10.5 million cash in the bank, land and plots worth Sh. 19.4 million, motorcycle, and five vehicles. The parcels of land are in Malindi, Kwale Township and Ndithini/Mananja. He also had accounts at Barclays, Equity, Cooperative and Standard Chartered banks.

EACC told the court that between June 18, 2008 and February 18, 2011, the officer had made cash and cheque deposits totaling Sh. 10.5 million in his bank accounts, excluding his salary account.

Now he is set to lose it all to the State following a petition by the Ethics and Anti-Corruption Commission to High Court of Kenya. The High Court has given the anti-graft agency the green light to recover the properties.

Justice Njoki Mwangi ruled that the properties constitute unexplained assets and were not a representation of his earning power.

“It is my finding that Mulei did not offer any explanation as to why deposits amounting to Sh. 10,536,199 were made to his various bank accounts, excluding his salary account,” Justice Njoki ruled. The amount should be paid within 30 days.

“The properties the subject of this suit, as well as the deposits in his bank accounts, raise questions with respect to their sources. I am satisfied, on the evidence placed before me by EACC, that Mulei has unexplained assets.”

The court ruled that the chief inspector had the evidential burden to offer a satisfactory explanation on how he had acquired the wealth, which he failed to do.

“When the burden of proof shifted to him, he made a feeble attempt to respond to the claims by EACC by stating that he had been in active employment for two decades and had been earning a decent salary,” Justice Njoki ruled.
