How Ardhi Sasa is going to change the real estate industry in Kenya

A few months ago, the government announced that the lands registry was going digital, thanks to the many reforms being implemented by the Lands Ministry. The move saw the introduction of the National Land Information Management System, which is popularly known as Ardhi Sasa, was officially launched by President Uhuru Kenyatta in April.

Ardhi Sasa will improve the security of land records, speed up land transactions and minimize fraud and corruption.

The new system will have all parcels of land moved to one regime known as the Registry Index Maps (RIMS), which will replace deed plans as registration instruments for land.

The platform has brought in a form of much needed disruption in the real estate business and here are some of the changes to expect going forward.

With the new system, Kenyans will be able to carry out land related transactions from the comforts of their homes, with just a click of a button. Some of these services include; search for land transactions, transfers and registrations.

  • This will also have reduced to zero human transactions, which has been the case for very many years, whereby individuals had to make their way to Ardhi House and queue for long hours to be served during transactions. In a nutshell, there will be no more delays.
  • The reduction of human transactions also reduces fraud in the real estate sector. Corrupt officials will now not be able to manipulate land records at the registries since everything is digitized. Fraud in the business was highly facilitated by brokers who sold non-existent lands to clients, while others sold a piece of land to multiple buyers.
  • Ardhi Sasa will have easily accessible to Kenyans, an updated and verified database of land records. Cases of double registration and double allocations will be a thing of the past.
  • This also means the land conversion exercise to RIMs will be devolved to the county registries.

Here are the steps taken during a title conversion exercise;

  1. Preparation of cadastral maps and the conversion list indicating new and old numbers for parcels of land within a registration unit and their corresponding acreages.
  2. Publication or gazettement of the cadastral maps and conversion list by Lands Cabinet Secretary within 30 days.
  3. Submission of any complaints that may arise and their consideration by the ministry.
  4. Land owners will apply for replacement of old title documents new titles.
  5. Closure of old registers and the registry will replace old titles with new ones which can now be used for any transactions.

The Ardhi Sasa platform is current active in Nairobi and will in the next few months be rolled out countrywide.
