Nairobi woman sues tycoon Jimnah Mbaru, demands Sh. 4.4mn child support

A 24-year-old woman has come out to file court papers suing businessman Jimnah Mbaru over lack of child support and neglecting his parental duties. The woman seeks to gain over Sh. 4.4 million annually in child support.

She claims that she was with Mbaru up until 2018 when she sired a child with him and he unceremoniously exited the relationship. The woman argues that since then, he has neglected parental responsibilities for his 3-year-old child.

Through her lawyer Suyianka Lempaa, she filed the affidavit seeking child support before the Nairobi’s Children court. This entails a monthly maintenance fee of Sh. 320,000, annual school fees amounting to Sh. 600,000.

The monthly maintenance expenses she seeks to be sheltered from are Sh. 50,000 each for food, medical expenses, clothes and househelp. She also wants another Sh. 100,000 for monthly shopping and Sh. 20,000 for miscellaneous expenses. This totals to Sh. 320,000 per month.

Businessman Mbaru is said to have given his parental duties to another man identified as Erick Murimi Kaburu. This was accomplished through the power of attorney and made the man become a ‘putative father’ to Mbaru’s alleged son.

The putative father was required to pay Sh. 50,000 monthly which has not been remitted to the maintenance of the minor.

Furthermore, the woman claims that Mbaru declined to have his name included in the birth certificate as the biological father to the minor, thus denying identity.

“That on 1st September 2020 the 1st respondent instructed and gave power of attorney to one Eric Murimi Kaburu to be a putative father to the minor terms of which are not known in any law including the constitution of Kenya,” reads court papers.

The woman accuses Mbaru of neglecting their child by giving a stranger power of attorney to take care of his mental, physical and emotional well-being while he is the biological father.

“Mbaru is a senior citizen, a prominent businessman who owns businesses worth billions of shillings including banking and control of Nairobi Security Exchange and therefore capable of supporting the child without any difficulties,” court documents read.

The woman now wants an order compelling Mbaru’s name to be included in the birth certificate of the minor as his biological father.
