Days after the Milimani Commercial Court ordered for the reopening of Keroche Breweries, the Kenya Revenue Authority has rushed back to court to get orders to shut down Keroche yet again.
“The Kenya Revenue Authority has today 18th July 2022 moved the High Court to vacate and set aside an order issued on 15th July 2022 in HCCC NO. E250 OF 2022 Keroche Breweries Limited vs Kenya Revenue Authority, which directed the reopening of Keroche,” KRA said in a statement.
“It is the Authority’s view that the case filed in Court by Keroche and the Orders sought go contrary to previous orders issued by the same Court and the consent agreements arrived at and signed by the two parties.”
Keroche Breweries was reopened by High Court Judge Alfred Mabeya of the Milimani Commercial Division.
“An order be and is hereby issued that the defendant taxman, its officers, agencies associates to unseal the packaging line, the stores and to reactivate the Exercisable Goods Management System (EGMS) in the Applicant’s Keroche Breweries plant in Naivasha and to generally allow the applicant to carry on with business forthwith,” the High Court ruled.

The court also ordered that Keroche pay Sh. 8 Million every 30th day of the month to the Kenya Revenue Authority (KRA) until the next court hearing which was scheduled for September 22, 2022.
As a surety that Keroche would honor this, they were required to pay Sh. 8 Million within the first 7 days after the ruling, as the first installment of the tax arrears. On the other hand, KRA was now required to step back and avoid closing, interrupting or intruding on Keroche Breweries’ operations.
