Meru man who slept at police station with wife’s body gets Sh. 1.5 million

The High Court has awarded Sh. 1.5 million to Charles Mwenda who sent the night at a police station with his wife’s coffin in May 2020. Mwenda had sued the State for infringing on his human rights.

In a ruling that was made on Wednesday, June 30, Justice Edward Muriithi directed the Inspector General of Police Hillary Mutyambai to bear the cost of compensation.

Charles Mwenda had told the court how he and 31 mourners were mistreated by the police officers after a long ride from Malindi in Kilifi county on May 28, 2020. Mwenda was transporting his wife’s body to Meru for burial but was forced to spend the night at Kianjai police station with the corpse on grounds that he was traveling beyond curfew time.

Prior to making the journey home, Mwenda claims he had obtained all the necessary documents and had even undergone the required tests just to be sure. With the requisite documents in hand, Mwenda crossed police barriers from Malindi until he got to the Meru-Tharaka Nithi border, where trouble began.

“An order is hereby issued that the actions by the police under the national police service headed by the first responded violated the provisions of the constitution under articles 3,4,10, 19,25, 28 & 29 and thus infringed on the rights to dignity, protection against torture and cruel, inhuman degrading treatment of the petitioner under the bill of rights of the constitution of Kenya 2010. There will be an order therefore for compensation for Sh. 1.5 million as general and exemplary damages against the first respondent for violating the petitioner’s constitutional rights,” the court ruled.
